Terms of Service
Brique Listing Media
Effective Date: January 1, 2026
These Terms of Service (“Terms”) govern the use of services provided by Brique Listing Media, operating in the State of Georgia. By booking, purchasing, or using our services, you agree to be bound by these Terms.
1. Services Provided
Brique Listing Media provides real estate marketing services including, but not limited to: photography, video, floor plans, 3D tours, virtual staging, rush delivery, listing websites, and related media services (“Services”).
All Services are provided for marketing purposes only and do not constitute appraisals, inspections, surveys, or legal representations.
2. Booking & Payment
How Booking Works
When you book with Brique Listing Media, you are reserving a specific date and time on our production calendar. Your booking is not confirmed until the required deposit is paid and you receive a booking confirmation.
Deposit (Required to Reserve Your Slot)
A $50 deposit is required to secure any booking. The deposit:
reserves your time on our calendar,
is applied toward your final invoice, and
is required even if the property is vacant.
Remaining Balance (Due Before Delivery)
The remaining balance for your selected package and any add-ons is due before final delivery of your media (photos, video, floor plans, and/or 3D tours).
After the shoot, we will send an invoice for the remaining balance. Final files are released only after the invoice is paid in full. If payment is delayed, delivery is delayed.
What You Pay For Upfront vs. Later
At booking: $50 deposit
After the shoot / before delivery: remaining balance + any add-ons, rush fees, or approved extras
Add-ons, Rush, and Extra Services
If you request add-ons (example: rush delivery, additional edits, extra spaces, or additional deliverables), those charges will be added to the remaining balance invoice unless otherwise stated in writing.
Payment Methods
We accept online card payments through our checkout and invoicing tools. You are responsible for ensuring your payment method is valid and able to process the charge.
Failed Payments, Chargebacks, and Collections
If a payment fails, we may pause work and/or hold delivery until payment is successfully completed. Chargebacks or payment disputes may result in:
immediate suspension of delivery,
cancellation of future bookings, and
collection of any unpaid balances, including reasonable administrative costs.
Pricing Accuracy
Prices shown at the time of booking are based on the package selected and the information provided. If the scope changes (example: additional rooms, additional deliverables, or special access requirements), we will confirm any price changes in writing before proceeding.
3. Cancellations & Rescheduling
Appointments may be rescheduled with at least 24 hours’ notice at no charge.
Cancellations made with less than 24 hours’ notice may be subject to a cancellation fee of up to 50% of the service price.
No-shows will be charged 100% of the service fee.
Weather-related delays will be handled at our discretion to ensure media quality.
4. Property Readiness
The client is responsible for ensuring the property is:
Clean, staged, and ready at the scheduled time
Accessible (unlocked or attended)
Free of hazards or unsafe conditions
Brique Listing Media is not responsible for delays, reduced quality, or reshoots caused by unprepared properties.
5. Delivery Timeline
Standard delivery timelines are estimates, not guarantees.
Rush delivery services prioritize processing but may be affected by unforeseen circumstances. No refunds are issued for delays caused by factors beyond our control.
6. Intellectual Property & Usage Rights
Brique Listing Media retains full copyright ownership of all media produced.
Upon full payment, the client is granted a non-exclusive, non-transferable license to use the media solely for marketing the specific property photographed.
Media may not be:
Sold, licensed, or transferred to third parties
Used for unrelated properties
Altered beyond basic cropping or resizing without written permission
We reserve the right to use all media for portfolio, marketing, advertising, and promotional purposes.
7. MLS & Platform Compliance
It is the client’s responsibility to ensure compliance with MLS, brokerage, and platform-specific rules. Brique Listing Media is not liable for listing rejections, fines, or violations resulting from platform policies.
8. Liability & Indemnification
Brique Listing Media is not liable for:
Property damage not caused by gross negligence
Inaccurate measurements, square footage discrepancies, or mapping errors
Loss of income, listing performance, or buyer decisions
You agree to indemnify and hold harmless Brique Listing Media from any claims arising from use or misuse of delivered media.
9. Limitation of Liability
To the fullest extent permitted by law, total liability shall not exceed the amount paid for the specific service giving rise to the claim.
Under no circumstances shall Brique Listing Media be liable for indirect, incidental, or consequential damages.
10. Force Majeure
We are not responsible for delays or failure to perform due to events beyond reasonable control, including but not limited to severe weather, equipment failure, illness, or government restrictions.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Georgia, without regard to conflict-of-law principles.
Any disputes shall be resolved exclusively in the courts located in Fulton County, Georgia.
12. Modifications
Brique Listing Media reserves the right to update these Terms at any time. Continued use of our services constitutes acceptance of the revised Terms.
