Real Estate Media Licensing Policy (MLS Use) — Atlanta
This Licensing Policy explains how you may use the photos, videos, three-dimensional tours (3D Tours), floor plans, and related deliverables (“Media”) created by Brique Listing Media for real estate marketing. This policy is written for realtors, brokerages, property owners, and marketing teams who need clear, practical rules.
Short version: You can use your Media to market the property, post it to the Multiple Listing Service (MLS), and promote your work (including “Just Sold” and portfolio). You can share the Media with your authorized vendors who are helping you market the listing. You cannot resell the Media, use it to market a different property, or let third parties use it for their own promotion without permission.
1. Definitions
Media: Photos, videos, 3D Tours, floor plans, virtual staging, virtual twilight, listing websites, and related files delivered by Brique Listing Media.
Client: The person or entity that purchases the services (typically the listing agent, brokerage, or property owner).
Listing: The specific property address associated with the order.
2. Ownership
Brique Listing Media retains copyright and ownership of all Media. The Client receives a license to use the Media as outlined below.
3. License Granted
Upon full payment, the Client is granted a non-exclusive, non-transferable license to use the Media for:
Marketing and advertising the Listing
Online and print marketing tied to the Listing
Agent and brokerage self-promotion that references the Listing as past work (examples: “Just Sold,” “Recently Sold,” listing presentations, portfolio)
This license is intended to support professional real estate marketing while protecting the Media from resale, misuse, or unauthorized third-party commercial use.
4. Permitted Uses (Realtor-Friendly)
You may use the Media for:
Multiple Listing Service (MLS) uploads and agent/brokerage listing platforms
Standard MLS syndication to consumer portals (example: Zillow, Realtor.com, Redfin)
Agent/brokerage websites, social media, email marketing, print marketing, flyers, postcards, signage, and paid advertising
Listing presentations and marketing materials that reference the Listing as your past work (including after it sells)
Property websites created for the Listing
MLS Syndication: Uploading to the Multiple Listing Service (MLS) and standard MLS syndication/portal distribution is permitted as part of marketing this Listing.
5. Permitted Users (Your Team + Your Vendors)
The license applies to:
The listing agent
The brokerage representing the Listing
The property owner (only for marketing the same Listing)
The agent/brokerage’s authorized team members and vendors (examples: marketing assistant, virtual assistant, transaction coordinator, designer) solely for marketing this Listing and the agent/brokerage’s services
Authorized vendors may use the Media only to perform work for you and may not use the Media for their own portfolio, advertising, resale, or promotion without written permission.
6. Prohibited Uses
The Media may not be:
Sold, sublicensed, shared as stock, or transferred for use outside the scope of this Listing
Used to market a different property, development, business, product, or service without an additional license
Used by builders, designers, stagers, architects, vendors, contractors, or third parties for their own promotional use without written permission
Altered in a misleading or deceptive manner (examples: removing permanent defects, materially changing layout/condition, or misrepresenting property features)
7. Term and “Past Work” Use
Active Listing Marketing: Allowed while the Listing is being marketed.
After Sale/Lease/Off-Market: You may continue to use the Media for agent/brokerage self-promotion that references the Listing as past work (examples: “Just Sold,” portfolio, listing presentations, “recent work” showcases).
Relisting: If the property is relisted by a different agent, different brokerage, or a different owner marketing campaign, a new license may be required.
8. Payment, Watermarks, and License Activation
The license becomes active upon full payment.
Until payment is completed, any previews provided may be watermarked, and the license is not active.
9. Attribution
Attribution is not required. If you choose to credit us, use: Brique Listing Media.
10. Brique Listing Media Portfolio Use (With Privacy Option)
Brique Listing Media may display delivered Media for portfolio and self-promotion (website, social, ads).
If the Client requests privacy (example: high-profile or sensitive listings), we will honor a written request to:
Withhold the address, and/or
Not publish the Media publicly
11. Third-Party Requests
If a third party (example: builder, designer, stager, contractor, publication) requests use of the Media for their own promotion, they must request permission directly from Brique Listing Media. Additional licensing fees may apply.
12. Violations and Enforcement
Unauthorized use may result in:
Revocation of the license
Additional licensing fees
Takedown requests
Legal action where appropriate
